Articles & Press Releases March 2008 Informational LetterSome of you may have already heard that, as of January 1, 2008, Illinois passed the Employee Classification Act in an effort to prevent employees from incorrectly classifying someone as an independent contractor when that someone is really an employee. The actual language of the Act states that its purpose “is intended to address the practice of misclassifying employees as independent contractors.” (Public Act 095-00260, Section 3). Did you know there is an Act in Illinois called the Home Repair and Remodeling Act that has been in effect since January 1, 2000? Its purpose is to improve communication between consumers and persons engaged in the business of home repairs or remodeling in order to “increase consumer confidence, reduce the likelihood of disputes and promote fair and honest practices in that business.” 815 ILCS 513/5 (West 2004).
